Terms of Service

These terms govern the web design and related services provided by Nowadays Digital Studio ("we", "us", "our") to our clients ("you", "your").
1. Services
We provide:
- Website design and development
- Website hosting and maintenance (Care Plans)
- Brand design services (logos, social media assets, print materials)
- Related digital services as described in our packages
2. Packages and Pricing
Our services are offered in packages (Essential, Plus, Premium) with clearly defined deliverables. Current pricing is displayed on our website. Launch promotional pricing is available for a limited time.
All prices are in Euros (EUR). As an auto-entrepreneur under the French franchise de TVA regime, VAT is not applicable (Article 293 B du CGI). Prices shown are net — no VAT is charged.
3. Payment Terms
- Essential package: Full payment required before work begins
- Plus and Premium packages: 50% deposit to begin work, 50% upon completion before launch
- Care Plans: Billed monthly or annually in advance
- Payment methods: Bank transfer, card payment
Work begins upon receipt of payment (or deposit for Plus/Premium). Final website launch occurs only after full payment is received.
Late payment penalties: Any late payment will incur penalties calculated at the minimum legal rate of three times the French statutory interest rate (7.86% per annum for H1 2026), in accordance with Article L441-10 of the French Commercial Code. A fixed recovery fee of €40 will also be due automatically (Article D441-5 of the French Commercial Code).
4. Timeline and Delivery
We commit to delivering your website within the timeframe specified for your package (7 business days), provided that:
- You provide all required content (text, images, logos) within 48 hours of request
- You respond to feedback requests within 48 hours
- No major scope changes are requested during the project
Delays caused by late content delivery or slow feedback will extend the timeline accordingly.
5. What You Need to Provide
- Business information (name, address, contact details, hours)
- Logo (if available) or approval for us to create one (Premium tier)
- Photos of your business, products, or services
- Menu, service list, or pricing information
- Any specific text or copy you want included
If you cannot provide photos, we can source professional stock images relevant to your industry at no additional cost.
6. Revisions and Approval
Before launch, you will receive a preview link to review your website.
- Pre-launch revisions: 2 revision rounds are included in the package. Each round consists of grouped feedback, processed in a single pass. Additional rounds are billed at €50 per round
- Post-launch revisions (within 2 weeks): Minor tweaks included at no cost
- Ongoing changes: Included with Care Plans according to your tier's monthly limit
Revisions refer to changes within the original scope. Requests for new features, additional pages, or major redesigns constitute a scope change and require a new quote.
7. Cancellation and Refunds
We do not launch your website until you approve it.
- Cancellation before work begins: The deposit or payment will be fully refunded
- Cancellation after work begins: The deposit is non-refundable
- No response: If you fail to provide the required content or stop responding for 30 days after our last communication, the project will be considered closed and the payment made will be retained
Once you approve the website for launch, the project is considered complete and no refunds will be issued for the website package.
8. Care Plans
A Care Plan is required to keep your website online. Care Plans include hosting, security, backups, and varying levels of support and updates.
- Cancellation: You may cancel your Care Plan at any time with 30 days notice. Your website remains live until the end of your current paid period
- What happens after cancellation: Once your paid period ends, your website will go offline. We will return your content (text, images, logos) upon request
- Buyout option: You may purchase full ownership of the design and source code at any time for a one-time fee of €300, allowing you to self-host your site or transfer it to another provider
9. Intellectual Property
- Your content: You retain ownership of all content you provide (text, photos, logos)
- Your domain: Registered in your name — you own it completely
- Design and code: The design, source code, and technical architecture remain the property of the provider. You may not resell or redistribute the design
- Usage license: You have a license to use the design for the duration of your Care Plan subscription, or permanently after payment of the buyout fee (€300)
10. Limitation of Liability
Our liability is limited to the amount you paid for our services. We are not responsible for:
- Lost profits or business opportunities
- Issues caused by third-party services (hosting outages, domain registrar issues)
- Content you provide that infringes on others' rights
- Accuracy of information you provide for your website
11. Confidentiality
We will keep your business information confidential and will not share it with third parties except as necessary to provide our services (e.g., hosting providers).
We may feature your completed website in our portfolio unless you request otherwise.
12. Termination
Either party may terminate our agreement:
- By you: At any time, with payment for work completed
- By us: If you fail to pay, provide required content after repeated requests, or engage in abusive behavior
13. Right of Withdrawal
Our services are intended exclusively for professionals (B2B). In accordance with Article L221-3 of the French Consumer Code, the 14-day right of withdrawal does not apply to contracts concluded between professionals.
If you are an individual consumer, you benefit from a 14-day right of withdrawal from the date of the contract, unless the performance of services has begun with your express agreement before the expiry of this period.
14. Force Majeure
Neither party shall be liable for delays or failures in performance resulting from circumstances beyond reasonable control, including but not limited to natural disasters, internet outages, third-party service failures, government actions, or pandemics.
15. Governing Law
These terms are governed by French law. Any disputes will be resolved in the courts of Metz, France.
16. Changes to Terms
We may update these terms from time to time. Existing clients will be notified of significant changes. Continued use of our services constitutes acceptance of updated terms.
